My nationally acclaimed book, DIVORCED FROM JUSTICE: The Abuse of Women and Children by Divorce Lawyers and Judges*, identified dangerous conditions for legal consumers in the divorce courts that allow many types of abuses to occur. Since the book was published in 1996, my continued research has led me to conclude that not much has changed: spouses at High-Risk for bad divorces continue to be thrust into the divorce court system at their own peril. Here are a few of the most dangerous current conditions:

  • Since most lawyers still bill by the hour, the divorce court system is geared to lawyers’ profit. This system has a corrupting influence on lawyer conduct and creates the incentive to “churn a case” until the money runs out.
  • The self-regulatory system for lawyers and judges still puts the foxes in charge of the hen house. According to Halt.org, a 2006 American Bar Association survey found that out of 123,927 complaints against lawyers, only 3.5 percent led to formal discipline and less than one percent resulted in disbarment.
  • Despite new “civility” rules in some states which attempt to discourage discourteous behavior by lawyers, many lawyers still play dirty by falsely discrediting the opposing spouse in court. To the lawyers who are involved, these tactics are generally thought of as a rough game -- business as usual.

These conditions enable the spouse with more clout – political power, standing or money -- to obtain leverage over the spouse with less clout, resulting in a playing field that is not fair. Given the situation, you need to plan how to put your energies into preserving your interests and minimizing your risks and losses. But beware: because of these conditions, your expectations of fairness and justice might not be met.

As an advocate for reform and as a lawyer, I can tell you that until the system is reformed, it is caveat emptor: let the legal consumer beware.
